Terms of Sale

1. Overview and Who We Are
These Terms of Sale (“Terms”) govern purchases made through the Pickleheart online shop (the “Shop”).
The Shop is operated by Strivers United Inc., a nonprofit corporation organized under Section 501(c)(6) of the Internal Revenue Code, doing business as “Pickleheart” (“Pickleheart,” “we,” “us,” or “our”).

These Terms apply to purchases of:
- Physical products (including print-on-demand merchandise),
- Memberships,
- Non-physical products or services, and
- Donations, where offered.
By placing an order through the Shop, you agree to these Terms.
2. Seller of Record and Community-Branded Pages
Important Notice About Community Pages
Some Shop pages, collections, or products may appear to be branded for, sponsored by, or associated with a local pickleball community, park group, coach, or organizer (each, a “Community Partner”).
Regardless of how a page or product is branded:
- Pickleheart (Strivers United Inc. d/b/a Pickleheart) is the sole seller of record for all purchases made through the Shop.
- All payments are processed by Pickleheart through its payment processors.
- Community Partners do not sell products directly, do not process payments, and do not handle refunds or chargebacks.
Pickleheart may share a portion of proceeds from certain purchases with a Community Partner to support local programming, equipment, events, or community operations. Such revenue sharing:
- Does not create a partnership, agency, or joint venture,
- Does not make the Community Partner responsible for the transaction, and
- Does not change Pickleheart’s role as merchant of record.
3. Eligibility and Accounts
By placing an order, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and authorized to use the payment method provided.
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Products, Memberships, and Services
We offer a mix of physical products, memberships, and non-physical products or services.
- Physical products may be produced on demand and fulfilled by third-party fulfillment partners.
- Memberships provide access to benefits, programs, content, or services as described at the time of purchase.
- Non-physical products or services may include access to programs, events, tools, or digital experiences.
Product descriptions are provided for convenience. We do not guarantee that descriptions, images, or availability are error-free, and we reserve the right to correct errors or update offerings at any time.
5. Pricing, Currency, Taxes, and Fees
All prices are displayed in U.S. Dollars (USD). Although payment processors may support additional currencies, the Shop currently prices and settles transactions in USD.
You are responsible for:
- Applicable sales taxes, and
- Any shipping fees, which are displayed at checkout.
Prices may change at any time, but changes will not affect orders already accepted.
6. Order Acceptance and Cancellation
Your order constitutes an offer to purchase. We reserve the right to accept or decline orders for reasons including suspected fraud, errors, or fulfillment limitations.
Orders for made-to-order or print-on-demand items may not be cancelable once production begins. Cancellation requests must be submitted promptly to legal@pickleheart.org and are not guaranteed.
7. Payments
Payments are processed through Stripe via WooCommerce. Pickleheart does not store full payment card numbers.
By submitting payment information, you authorize Pickleheart and its processors to charge your payment method for the total amount shown at checkout.
8. Fulfillment and Shipping
Physical products are fulfilled by third-party partners, including Printful. Processing and shipping times are estimates only and are not guarantees.
At this time, the Shop ships within the United States only.
Risk of loss passes to you upon delivery to the carrier, to the extent permitted by law.
9. Returns, Refunds, and Exchanges
Our Refund & Return Policy is incorporated into these Terms by reference.
In general:
- Print-on-demand items are not returnable for preference or sizing issues.
- Defective, damaged, or incorrectly fulfilled items may be eligible for replacement or refund.
- Approved refunds are issued to the original payment method where feasible.
10. Donations and Non-Deductibility
Pickleheart is a 501(c)(6) nonprofit organization. Payments labeled as “donations” in the Shop are not tax-deductible as charitable contributions.
Donations are voluntary and generally non-refundable, except where required by law or where Pickleheart determines an error occurred.
Allocation of Donation Proceeds
For donation-designated items associated with a Community Partner, Pickleheart intends to allocate approximately 95% of net proceeds to support the designated community initiative and approximately 5% to support Pickleheart’s platform, administration, and payment processing.
These percentages are estimates and may vary due to payment processing fees, refunds, or chargebacks. Allocation disclosures are informational and do not create a trust or escrow arrangement.
Pickleheart does not provide tax advice.
11. Promotional Codes and Offers
Promotional codes and special offers are subject to additional terms and may be modified or discontinued at any time. They have no cash value and may not be combined unless explicitly stated.
12. Chargebacks and Disputes
If you have an issue with an order, please contact legal@pickleheart.org before initiating a chargeback. Unwarranted chargebacks may result in account restrictions or refusal of future orders.
13. Intellectual Property
All Shop content, designs, trademarks, and materials are owned by or licensed to Pickleheart and may not be used without permission.
14. Disclaimer of Warranties
To the maximum extent permitted by law, products and services are provided “as is” and “as available,” without warranties of any kind, express or implied.
15. Limitation of Liability
To the maximum extent permitted by law, Pickleheart will not be liable for indirect, incidental, or consequential damages. Pickleheart’s total liability for any claim related to a purchase will not exceed the amount paid for that order.
16. Indemnification
You agree to indemnify and hold harmless Pickleheart from claims arising out of your violation of these Terms or misuse of the Shop.
17. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute shall be brought in the state or federal courts located in New York County, New York, unless otherwise required by law.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the Shop after changes constitutes acceptance of the revised Terms.
